Terms of Service

These terms govern use of the OpenTulpa website and AI chatbot platform.
Agreement
By accessing opentulpa.com or using the OpenTulpa product, you agree to these Terms of Service. If you are using OpenTulpa on behalf of a business, you represent that you have authority to bind that business.
If you do not agree, do not use the website or product.
The service
OpenTulpa provides AI chatbot and messaging automation tools that help businesses answer messages, capture leads, and book appointments across supported channels. Features may change as we improve the product.
You are responsible for the business information, policies, escalation rules, and channel credentials you configure, and for reviewing chatbot behavior before and after go-live.
Accounts
You must provide accurate account information and keep credentials secure. You are responsible for activity under your account.
We may suspend or terminate accounts that violate these terms, abuse the service, create security risk, or remain unpaid after notice where payment is required.
Acceptable use
You may not use OpenTulpa to send spam, deceive customers, violate messaging-provider policies, infringe intellectual property, process unlawful content, attempt unauthorized access, or interfere with service integrity.
You must comply with applicable privacy, consumer-protection, telemarketing, and messaging laws for your industry and region, including disclosures and consent requirements for SMS, WhatsApp, or similar channels.
Customer data and conversations
You retain ownership of your business content and customer conversation data. You grant OpenTulpa a limited license to host, process, and display that data solely to provide and secure the service.
You are the controller of personal data collected from your end customers through your chatbot. Our Privacy Policy explains how we process personal information as a provider.
Billing
Paid plans are billed according to the pricing shown at checkout or in your account. Fees are generally non-refundable except where required by law or expressly stated in writing.
We may change pricing with reasonable notice for renewals. Failure to pay may result in suspension.
Third-party services
OpenTulpa may integrate with calendars, CRMs, messaging platforms, hosting providers, and payment processors. Those services are governed by their own terms. We are not responsible for outages or policy changes by third parties that affect channel access.
Disclaimers
The service is provided “as is” to the fullest extent permitted by law. AI-generated replies can be incorrect or incomplete; you should configure escalation rules and review outputs for high-risk situations.
We do not guarantee uninterrupted availability, specific ranking outcomes, or particular business results such as conversion rates.
Limitation of liability
To the fullest extent permitted by law, OpenTulpa and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from use of the service.
Our aggregate liability for claims relating to the service is limited to the amounts you paid OpenTulpa in the three months before the claim, or USD $100 if you are on a free plan, except where liability cannot be limited by law.
Indemnity
You agree to indemnify and hold OpenTulpa harmless from claims arising out of your content, your chatbot’s customer interactions, your misuse of the service, or your violation of these terms or applicable law.
Changes and contact
We may update these terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance of the updated terms.
